General Terms and Conditions (GTC)
1 Scope of Application
These General Terms and Conditions (GTC) apply to all business relationships between MAMBANE, Sabie Rd, Sabie, Mpumalanga, 1260 (hereinafter "Company") and the customers of mambane.co.za. The version of these GTC valid at the time the contract is concluded shall be authoritative. Conflicting or deviating terms and conditions of the customer shall not apply unless the Company expressly agrees to them. Customers within the meaning of these GTC include both consumers and corporate entities in accordance with applicable laws, including the South African Consumer Protection Act (CPA).
2 Conclusion of Contract
The presentation of goods on the website does not constitute a binding offer by the Company, but rather an invitation for the customer to submit an offer. By submitting their order, the customer makes a binding offer to conclude a purchase contract. The Company confirms receipt of the order via text or email. However, this order confirmation does not yet constitute an acceptance of the offer. A contract is only concluded upon the dispatch of a separate order confirmation or the delivery of the goods.
3 Prices and Payment
All prices stated on the website are inclusive of statutory Value-Added Tax (VAT) and exclusive of shipping costs. The customer can choose between the following payment methods: PayFast, Yoco, Ozow, PayPal, Credit Card, Apple Pay and EFT. The payment of the purchase price is due immediately after the conclusion of the contract, unless deviating payment terms have been agreed upon.
4 Shipping Costs and Delivery
In addition to the purchase price, the customer bears the specified shipping costs, which are shown separately before the completion of the order. The Company delivers worldwide. The respective delivery times are indicated on the website and in the order confirmation. For deliveries to countries outside South Africa, additional customs duties, taxes, and fees may apply, which are to be borne by the customer.
5 Retention of Title
The goods remain the property of the Company until the purchase price has been paid in full.
6 Right of Withdrawal / Returns for Consumers
Consumers are entitled to a statutory right of return. Cancellation Policy: You have the right to withdraw from this contract within 3 days without giving any reason. The withdrawal period is 3 days from the day on which you, or a third party named by you, took possession of the last goods. To exercise your right of withdrawal, you must inform us (MAMBANE, Sabie Rd, Sabie, Mpumalanga, 1260, Email: info@mambane.co.za) of your decision to withdraw from this contract by means of a clear statement. The cost per return is calculated according to your order total, inclusive of shipping distance, which will be deducted from the refund. This is a processing and courier fee for the return. For returns from within South Africa, please use contact an Advsior. If you wish to return an order from outside South Africa, please send the items to the following address: MAMBANE, Sabie Rd, Sabie, Mpumalanga, 1260, South Africa.
MAMBANE does not cover return shipping costs for orders from within and outside South Africa.
7 Warranty and Liability
Statutory warranty rights apply. The Company is unrestrictedly liable for damages resulting from intentional or grossly negligent behavior. For simple negligence, the Company is only liable in the event of a breach of essential contractual obligations, and liability is limited to foreseeable damages typical for the contract.
8 Data Protection
The Company commits to treating the customer's personal data in accordance with applicable data protection regulations (including the Protection of Personal Information Act - POPIA). Further information can be found in the separate Privacy Policy on the website.
9 Final Provisions
South African law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a corporate entity or merchant, Johannesburg, South Africa, is agreed upon as the place of jurisdiction. Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
